North Whitehall Township’s Outdoor Open Burning Ordinance is essential for protecting public impact, enhancing local fire safety, and maintaining environmental standards across our Township while allowing for specific outdoor fires. As local conditions, air quality regulations, and land-use patterns evolve, the burning regulation addresses fire hazards, establishes clear standards for residential and commercial burning, and equips fire responders with enforceable guidelines. The ordinance aim is to balance individual property rights with community safety, reducing preventable fire risks and nuisance smoke while maintaining clear, transparent rules for all residents.

Permit-Free Backyard Burning: The ordinance contains clear definitions and regulations for small-scale fires using approved containers (such as patio burners and chimineas) without requiring a permit, provided they meet specific size and setback criteria. Agricultural Exemption: Farming operations remain unaffected; primary agricultural burning related to crops and livestock is allowed under the regulations.

Burning Permit: Large bonfires and other fire types require a permit issued and regulated by the Fire Code Administrator.  A permit must be applied for in advance for special consideration for open fires not specifically allowed by the ordinance. Applications will be reviewed on a case-by-case basis evaluating the special purpose, location, setbacks, size, conditions and potential community effects.
