PLANNING COMMISSION MINUTES OF JANUARY 26, 2010
Meeting brought to order at 7:30 p.m., on Tuesday, January 26, 2010 by Chairman Richard Celmer.

Minutes of the November 24, 2009 meeting were approved as presented.
- Planning Commission Chairman Richard Celmer welcomed Township Supervisor Jerry Joseph to the Planning Commission and congratulated Bruce Stettler and John Barto III on their reappointments to the Commission.
- Reorganization Meeting of 2010 - Leonard Nuss made the motion to nominate Richard Celmer as Chairman for 2010, Jeff Johnson seconded, all others agreed.
John Barto III made the motion to nominate Brian Horwith as Vice Chairman for 2010, Jeff Johnson seconded, all others agreed.
Jeff Johnson made the motion to nominate Bruce Stettler as Secretary for 2010, seconded by Leonard Nuss, all others agreed.
- LCCC Campus, Orchard Road Realignment and Berrier Hall Addition- Preliminary – Project # NWT 08-009 – Land Development, 4525 Education Park Drive, 153.39 acres, AR-1 zone, Parcel ID 5469 1293 3619-1, 90-Day Deadline starts 1/17/10, 90-Day Deadline 4/18/2010. The plan was presented by Scott McMackin; Cowan Associates, Carl Pickett; LCCC and Larry Ross; LCCC.
- Keystone Engineers have reviewed the plan and offered their comments and recommendations in a letter dated January 18, 2010.
- Zoning Officer's review is contained in his letter dated January 21, 2010.
- Sewage Enforcement Officer's review is contained in his letter dated January 22, 2010
- Traffic Engineer's review is contained in his letter dated January 21, 2010.
- Penn Dot’s review is contained in their letter dated January 12, 2010.
- The plan was originally presented in 2008 as just a road realignment.
- A revision to the plan includes an addition to Berrier Hall.
- The developer and their engineer have been working with the Township’s Traffic Engineer to update the new roadway design.
- Planning Commission member Joanne Guth suggested the construction in parking lot F should be added to the plan.
- Planning Commission member John Barto III commented on the improvements to the traffic pattern compared to the previous pattern; he is pleased with the update.
- Planning Commission member Jeff Johnson requested KnoxBox location be shown on the plan. Jeff is also concerned with the roadway radii; will an emergency vehicle have proper access? Jeff also did not see enough fire hydrants on the plan.
- Planning Commission member Leonard Nuss questioned the parking area marked proposed macadam, what is that now? Are they being added or are they being removed? Leonard requested how many spaces are being removed and/or added should be noted on the plan.
- The developer’s engineer stated the proposed macadam parking area is currently stone; this stone area will be eliminated and replaced with a macadam parking area.
- Planning Commission Chairman Richard Celmer requested an overview of the entire LCCC site be included with plan set. This should show all current and proposed buildings, parking lots, roadways.
Planning Commission has recommended the following conditions:
- Developer shall address to the satisfaction of the General Planning Engineer the comments and recommendations set forth in his letter dated January 18, 2010.
- Developer shall address the Zoning Officer's comments as set forth in his review letter dated January 21, 2010.
- Developer shall address the Sewage Enforcement Officer's comments as set forth in his review letter dated January 22, 2010.
- Developer shall address the Traffic Engineer's comments as set forth in his review letter dated January 21, 2010.
- Developer shall address Penn Dot’s comments as set forth in their review letter dated January 12, 2010.
- The construction information to parking lot F shall be added to the plan.
Jeff Johnson motioned to the table the plan until all the items discussed are cleaned-up, Bruce Stettler seconded, all agreed.
Rising Sun Farms Phase II, Lot 9- Preliminary/Final- Project # NWT – 09-017 – Minor Subdivision, 5828 Park Valley Road, 45 Acres, AR zone, Parcel ID 5560 5903 8411.Waiver request to be considered a Preliminary/Final, 90-Day Deadline starts 1/15/10, 90-Day Deadline 4/14/2010. The plan was presented by Steve Pany; Pany & Lentz Engineering and Laurie Atiyeh; developer.
- Keystone Engineers have reviewed the plan and offered their comments and recommendations in a letter dated January 18, 2010.
- Zoning Officer's review is contained in his letter dated January 21, 2010.
- Sewage Enforcement Officer's review is contained in his letter dated January 22, 2010
- Traffic Engineer's review is contained in his letter dated November 10, 2009.
- The lot proposed is for the existing guest house.
- Only a small portion is being subdivided and the remaining land will be farmed as it has been in the past.
- The developer has suggested moving the driveway to the center of the cul-de-sac to get it out of the way of the snow pile easement.
- The existing roadway-Harvest Place-has never been completed as per the approved subdivision. Developer stated this will be completed in spring.
- Planning Commission member Leonard Nuss stated the roadway, cul-de-sac and septic system were never completed from the previous subdivision.
- Planning Commission member John Barto III requested the existing farm house on lot 9 be shown on the plan.
- Planning Commission member Bruce Stettler questioned when the original subdivision regarding Harvest Place was started? Developer’s engineer stated in 2005. Bruce stated “then the road should be complete by now”.
- The developer indicated that once the guest house is subdivided, the funds received from this subdivision, would help in the completion of the road and cul-de-sac.
- Township Supervisor Jerry Joseph questioned whether the cul-de-sac was always intended to be a cul-de-sac or was it possibly a through street?
- Township Engineer Steve Gitch stated a through street was discussed with the developer during the previous subdivision phase and if any additional subdivision of the property is proposed, a plan showing a through street shall be submitted to the Township.
- Township Solicitor Lisa Young agreed with the Planning Commission members regarding the incomplete road and cul-de-sac.
- The developer stated they never intended not to finish the roadway.
Planning Commission has recommended the following conditions:
- Developer shall address to the satisfaction of the General Planning Engineer the comments and recommendations set forth in his letter dated January 18, 2010.
- Developer shall address the Zoning Officer's comments as set forth in his review letter dated January 21, 2010.
- Developer shall address the Sewage Enforcement Officer's comments as set forth in his review letter dated January 22, 2010.
- Developer shall address the Traffic Engineer's comments as set forth in his review letter dated November 10, 2009.
- Baron Home Builders shall also sign the plan as owners of the lot affected by the lot line adjustment and included on the plan.
- North Whitehall and Washington Township lines shall be identified on the plan.
Comments from the Floor:
Nina Weiss, 5795 Harvest Place, Schnecksville, stated 5 years ago our developer stated they were going to finish the roadway and cul-de-sac, the Township said no more development until this one is complete, Please stick to your guns! Also Ms. Weiss stated the land has not been farmed this past year.
James Ehritz, 5775 Harvest Place, Schnecksville, stated he purchased his property for the cul-de-sac and was never made aware of a possible through street; he likes the cul-de-sac for the safety. We all have deed restrictions for all homes in this subdivision and that guest house does not come close to following the deed restrictions, it is an eye sore, it is not up to code and it is too small.
Jim Falco, 5866 Park Valley Road, Schnecksville, stated this project was started 5 years and when it snows, the road is not plowed for a couple of days afterwards unless the builder, who is not the responsible party, comes and plows it. The road is still not complete, we, the residents would like the road dedicated to the Township so we can have it plowed and have leaf clean-up. We also do not want a through street, we like our cul-de-sac. We were never informed of the possibility of a through street.
Richard Uttard, 5830 Harvest Place, Schnecksville, stated he would like the road completed and does not want a through street, he prefers the cul-de-sac.
Gus Youwakim, 3075 Rockdale Road, Slatington, stated he was the builder of the homes in this subdivision and he does the plowing because he feels responsible for these residents. The road is not finished, the swale was not finished, and he completed that also. The guest house, in his opinion, should be condemned, there are cracks everywhere and there is also water in the basement.
Judy Danko, 5820 Harvest Place, Schnecksville, questioned if Baron Homes is aware of the need for a lot line adjustment? Mrs. Danko also questioned if this plan will be in compliance with the Township’s steep slope ordinance. Is this a smoke screen for a future development? Mrs. Danko is requesting the developer and the Township enter into a Municipal Service Agreement, stating the road will be completed if not the Township will complete it. Mrs. Danko also questioned whether there was an original improvements agreement from the Rising Sun Farms development.
Brian Horwith motioned to recommend a denial of the Preliminary Plan, Leonard Nuss seconded, all others agreed.
- Sheila M. Horwith Lot Line Adjustment- Final- Project # NWT – 10-006 – 4149 Hill Street, 80.2887 Acres, SR zone, Parcel ID 5479 6545 9013, 90-Day Deadline starts 1/26/2010, 90-Day Deadline 4/25/2010. The plan was presented by Brian Gasda; Lehigh Engineering and Sheila Horwith; land owner.
- Keystone Engineers have reviewed the plan and offered their comments and recommendations in a letter dated January 18, 2010.
- Zoning Officer's review is contained in his letter dated January 21, 2010.
- Sewage Enforcement Officer's review is contained in his letter dated January 22, 2010.
- Traffic Engineer's review is contained in her letter dated January 12, 2010.
- Penn Dot’s review is contained in their letter dated January 12, 2010.
- Currently the swimming pool encroaches on the existing side lot line; the proposed lot line adjustment will eliminate this problem.
- The property owner is proposing a future garage on the opposite side of the existing home.
- Township Supervisor Jerry Joseph questioned the lot line through the swimming pool?
- Landowner Sheila Horwith stated this lot line was not detected when the swimming pool application was submitted, but was realized when a garage application was submitted recently.
Planning Commission has recommended the following conditions:
- Developer shall address to the satisfaction of the General Planning Engineer the comments and recommendations set forth in his letter dated January 18, 2010.
- Developer shall address the Zoning Officer's comments as set forth in his review letter dated January 21, 2010.
- Developer shall address the Sewage Enforcement Officer's comments as set forth in his review letter dated January 22, 2010.
- Developer shall address the Traffic Engineer's comments as set forth in her review letter dated January 12, 2010.
- Developer shall address Penn Dot’s comments as set forth in their review letter dated January 12, 2010.
John Barto III motion to recommend Preliminary/Final approval, Jeff Johnson seconded, all agreed.
- North Whitehall Commercial Center, Lot 5, Wal-Mart Store – Preliminary – Project # NWT- 07-021 – Land Development, 3872 Route 309, south side of Route 309, opposite Levans Road, 32.67 acres, PC zone, Parcel ID# 5468 4911 9262. Current 90-Day deadline 2/17/2010. Bud Newton; Newton Engineering and Erick Schock; Fritzpatrick, Lentz & Bubba were present for questions regarding the plan.
Township Supervisor Jerry Joseph read a statement he prepared regarding Wal-mart’s request for Mr. Joseph to recuse himself. A copy of that statement is included in the minutes. Township Supervisor Jerry Joseph did not recuse himself.
Erick Schock stated Wal-mart was well within their right to request Township Supervisor Jerry Joseph to recuse himself.
Planning Commission Chairman Richard Celmer asked Township Solicitor Lisa Young what would her legal opinion be on this matter.
Township Solicitor Lisa Young stated that her legal opinion was that the courts have held that recusal is warranted when a member of a tribunal like the Board of Supervisors or Planning Commission participates as an advocate or witness in opposition to a plan or other matter. Many court decisions have determined that a bias exists in a situation such as this, or even to a lesser degree when a member is not necessarily a plaintiff in several actions but have found this bias where the member gave testimony in opposition at a zoning hearing or supported litigation in opposition in which their spouse was a litigant. This was discussed with Supervisor Joseph and the cases were presented to him with an explanation. Her legal opinion was that a bias exists with the member in question with regard to voting on these plans. This does not necessarily mean he cannot voice an opinion, simply the courts have held that a recusal on the vote is warranted.
Planning Commission Vice Chairman Brian Horwith questioned if the applicant could seek an injunction.
Township Solicitor Lisa Young stated that the applicant may choose to pursue an injuction if they desire and feel it is appropriate. To date, no actions have been filed against the Township by the developer.
Chuck Braymer, 3532 Apple Road, Orefield, stated “wasn’t the Township sued”; won’t there be bias also on the Township’s part?
Township Supervisor Jerry Joseph stated Wal-mart should give him a chance to do his work. He will put his bias aside, “leave it behind me and base my decision on facts and not feelings”.
The decision was made between the Planning Commission members and the Wal-mart representatives to continue the meeting Thursday 1/28/10 at 7:30pm. The building and the website will be posted regarding the continuation of the meeting.
Any other items that may be discussed at the discretion of the Planning Commission
Judy Danko, 5820 Harvest Place, Schnecksville, requests the Planning Commission draft a letter to the Board of Supervisors regarding the improvements agreement for Rising Sun Farms, the road conditions and the cul-de-sac.
Rich Casari, 4209 Iroquois Street, Schnecksville, stated Mr. Joseph has voted with intelligence and honor, give him a chance.
Nancy Braymer, 3532 Apple Road, Orefield, questioned if an answer to SALDO 10.3E will be given at the Thursday night continuation meeting of Wal-mart. Mrs. Braymer has a presentation on this subject she would like to make.
Planning Commission Chairman Richard Celmer assured Mrs. Braymer she be given time to make her presentation at the Thursday night meeting.

John Barto II made the motion for a continuance of the meeting to Thursday, January 28, 2010 at 7:30pm., Jeff Johnson seconded, all others agreed
